Beta & Early Access Agreement
This Beta & Early Access Agreement ("Beta Agreement") applies to any feature, model, or service that Zuyzo LLC ("Zuyzo," "we") designates as alpha, beta, preview, early access, or evaluation (collectively, "Beta Services"), including pre-release versions of PLCcode and the Fableloom models. It supplements the Terms of Service; where they conflict, this Beta Agreement controls for Beta Services.
01Nature of Beta Services
BETA SERVICES ARE PRE-RELEASE. THEY MAY CONTAIN DEFECTS, PRODUCE INCORRECT OUTPUT, LOSE DATA, CHANGE WITHOUT NOTICE, OR BE DISCONTINUED AT ANY TIME. THEY ARE PROVIDED FOR EVALUATION ONLY AND MUST NOT BE RELIED ON FOR PRODUCTION CONTROL OF EQUIPMENT OR FOR ANY REGULATED, VALIDATED, OR SAFETY-RELATED PURPOSE.
No service levels, uptime commitments, or support obligations apply to Beta Services. We may limit capacity, throttle usage, reset environments, or remove access at our discretion.
02License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Beta Services during the beta period, solely to evaluate them and provide feedback, and subject to the Terms of Service and any written instructions we provide.
03Feedback
If you provide suggestions, bug reports, ideas, or other feedback ("Feedback"), you grant Zuyzo a perpetual, irrevocable, worldwide, royalty-free license to use the Feedback for any purpose without restriction or compensation. Feedback does not include your Customer Content, which remains governed by Section 3 of the Terms of Service — your code stays yours, in beta and after.
04Confidentiality
Non-public aspects of the Beta Services — including features, performance data, model behavior, screenshots, benchmarks, pricing, and roadmaps — are Zuyzo's confidential information. You agree not to disclose them publicly without our prior written consent. If you and Zuyzo have a separate signed non-disclosure agreement, that agreement controls confidentiality between us.
05Beta data
Beta environments may be reset, and data created in them may be deleted without notice at the end of the beta period or earlier. Do not store the only copy of anything important in a Beta Service. We may collect additional diagnostic telemetry during beta to improve the Services, handled per our Privacy Policy.
06Term and termination
This Beta Agreement applies from your first access to a Beta Service until that service is made generally available, discontinued, or your access ends. Either party may terminate beta access at any time, for any reason. Sections 3, 4, and 7 survive.
07Disclaimer
BETA SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE WARRANTY DISCLAIMERS, LIMITATIONS OF LIABILITY, AND INDEMNIFICATION PROVISIONS OF THE TERMS OF SERVICE APPLY FULLY TO BETA SERVICES.
